General Terms and Conditions of Sale

Applicable to treatments offered by Beroa

 

Article 1: Preamble

The Client affirms they possess the full legal capacity to agree to these General Terms and Conditions of Sale, confirming they are at least 18 years of age and are not subject to guardianship or curatorship.

The Client declares that they are booking services for personal and private use, or, where applicable, are privately benefiting from a personal reservation or as part of a group reservation (for multiple individuals, associations, companies, works councils, or other organizations).

  • The Client, both for themselves and for any other participant, certifies the accuracy and truthfulness of the information provided for the proper execution of the treatment. They also certify that they have obtained consent for Beroa* to communicate and process their personal data.

  • Booking any treatment implies an unreserved acceptance, by both the Client and any other participant, of these General Terms and Conditions of Sale, which they acknowledge having read before confirming their reservation. These General Terms and Conditions of Sale form an integral part of the contract and supplement the preliminary information stipulated by Article R211-4 of the Tourism Code.

 

Article 2: Definitions

  • “Client”: refers to the person who books, or on whose behalf a spa service or treatment is booked with Beroa*.

  • Beroa* Institute: refers to the Spa

  •  Travel Agent/Provider: refers to a reseller with commercial agreements with Beroa* and authorized to sell its services.

  •  “Preview” Offer: a promotional operation that allows for a price reduction when a spa service or treatment is booked at least 60 days before the service start date, with a non-modifiable commitment and 100% payment of the treatment amount upon reservation*. This offer cannot be combined with other ongoing offers.

  •  “Good Deal” Offer: a promotional operation that allows for a price reduction when a spa service or treatment is booked between 60 and 7 days before the service start date, with a non-modifiable commitment and 100% payment of the service amount. This offer cannot be combined with other ongoing offers. This promotional operation results in the application of a one-time price reduction.

  •  “Themed” Offers, such as “Last Minute” offers, “Solo Offer”, “Duo Offer”, “Gift Card Offer”, etc.: promotional operations resulting in a one-time price reduction, with a non-modifiable commitment and full prepayment of the Service upon reservation, depending on the chosen offer and Beroa* Institute. These offers cannot be combined with other ongoing offers.  

 

Article 3: Content

  • These General Terms and Conditions of Sale define the rights and obligations of the Parties regarding the booking of Spa Services and treatments offered by Beroa*. The promotional offers referred to as “Preview”, “Good Deal”, and “Themed” are subject to specific conditions as detailed herein.

  • These General Terms and Conditions of Sale may be modified at any time without prior notice. Such modifications will not apply to reservations made previously. Only the General Terms and Conditions of Sale in effect at the time of booking are enforceable against the Client.  

 

Article 4: Services Offered by Beroa*

  •  The services offered by Beroa* are detailed within the offers of the respective Beroa* Institute, on the website www.beroa.fr, and in the corresponding price brochures. These can be accessed on the www.beroa.fr website page dedicated to the specific Spa or upon simple written request.

  • The Spa operating hours, listed in the “Frequently Asked Questions” section of each Beroa* Institute's website, are specific to each Beroa* Institute and are subject to change without prior notice.

  •  Languages spoken at Beroa* establishments: French and English. 

 

Article 5: Access Conditions

Clients must be over 16 years of age to access treatments that include a hammam.

 

Article 6: Accessibility - Persons with Reduced Mobility  

The entire Beroa* Arcachon Spa is accessible to persons with reduced mobility. 

 

Article 7: Price

  • The Client guarantees that they are fully authorized to use the payment method provided for their order and that it grants access to sufficient funds to cover all costs resulting from the purchase of their service.

  • Unless a specific promotional offer applies, the rates are those listed in the price brochure of the relevant Spa Beroa* and on its dedicated webpage at https://www.beroa.fr, in effect at the time of booking.

  • The prices displayed are in euros, including all taxes, and are only valid for the dates specified on the booking confirmation.

  • Prices include the VAT applicable on the day of booking, and any change in the applicable VAT rate will be automatically reflected in the stated prices.

 

Article 8 : Gift Cards

Gift cards are valid for one year. Upon purchase, a code is generated and will only be valid for a period of one year.

 

Article 9: Booking Services

  • Bookings can be made:

o by phone at 09 51 62 10 13 (standard call cost, not surcharged),
o by email at: contact@beroa.fr,

o via the website https://www.beroa.fr

 

Article 10: Booking Confirmation

  •  Following their order, the Client receives a booking confirmation. The confirmation of the Client's booking by Spa Beroa* is contingent upon the payment of the services' price, as defined by Article 10.

  • The booking confirmation summarizes the services ordered and their corresponding prices.

 

Article 11: Payment for Services

  • All Spa and Treatment services must be paid in full before the service is rendered, either by bank transfer or by credit card (Carte Bleue, Visa, American Express, MasterCard/Eurocard), with the cardholder being the person making the booking. Bookings made online are payable by credit card only. The Client acknowledges having authorized the debit of the corresponding amount.

  • Any service not utilized will not be refunded.

 

Article 12: External Services

  • Articles 9 and 10 above do not apply to online bookings made through a Travel Agent/Provider website that has a current agreement with the relevant Spa Beroa*. The applicable booking and payment terms are those offered by the said travel website. 

  • In any event, before the treatment start date, the Client must possess a Voucher from the online Travel Agent/Provider through whom the service corresponding to the booking was paid.

 

Article 13: Medical Consultations and Health Status

  • Some Spa Beroa* locations offer Spa Treatments and/or services suitable for pregnant women (please inquire with the relevant Spa Beroa*). Pregnant women are advised to consult their doctor before making any booking to confirm their suitability for the available treatments. It is the Client's responsibility to specify their pregnancy status when booking.

  • The main therapeutic contraindications for Spa and hammam treatments include:

- pregnancy or breastfeeding
- lack of autonomy
- surgery within the last 3 months
- high blood pressure
- depression
- recent trauma, fractures
- endocrine disease: uncontrolled thyroid dysfunction
- infectious and contagious diseases (fever, tonsillitis, acute infections)
- neurological diseases (unstable epilepsy, multiple sclerosis, Parkinson's disease, etc.)
- respiratory diseases (acute or chronic, severe asthma, etc.)
- venous disease: recent phlebitis
- psychiatric illness: if unstable
- cardiovascular diseases (heart failure, arteritis of the lower limbs, recent heart attack, acute heart disease, unstable rhythm disorder)
- rheumatological diseases (acute rheumatic flare-up, severe osteoporosis, herniated discs)
- active cancer or cancer under treatment (chemotherapy, radiotherapy, aplasia)
- metastases or progressive recurrence of cancer
- dermatological infection (recent unhealed wound or scar, weeping, purulent, eczema, psoriasis, unhealed shingles, chronic conditions, varicose ulcer)
- cancer in remission
- cardiovascular disease (including treated and stabilized)
- high blood pressure
- kidney disease,
- dermatological disease
- acute infection

For an exhaustive list of therapeutic contraindications, clients are advised to seek all necessary information from a physician of their choice. 

Article 14: Client Modifications and Cancellations

  • It is important to note that promotional offers such as 'preview,' 'special deal,' and 'themed' are non-modifiable, non-cancellable, and non-refundable.

  • For services not covered by promotional offers, the buyer may modify or cancel their treatment, free of charge, up to 48 hours before the appointment date, within their dedicated client area. Spa Beroa* will process the refund to the Buyer within 15 calendar days. After the 48-hour period, in the event of cancellation, the service will be considered rendered and will not be refunded to the Client.

  • Should the Client cancel their reservation on the day of the treatment, or fail to attend the institute for their scheduled treatment, no refund will be provided.

 

Article 15: Modifications or Cancellations by Beroa*

  • If, prior to the scheduled service date, Beroa* is compelled to cancel or modify a service reserved by the Client, Beroa* will notify the Client via email.

  • Beroa* will then offer the Client alternative dates for the reserved service, or a new service, or an equivalent service from the same collection of establishments. The Client must promptly inform Beroa* of their decision. 

  • Should the Client accept the new service or agree to postpone the dates of their service, no compensation will be due. Furthermore:

- If the price of the new service is lower than that of the original service, the difference will be deducted or refunded, depending on the payment status of the balance, as of the modification date.
- If the price of the new service is higher than that of the original service, the difference will be covered by Beroa* as compensatory and transactional settlement.

  • If the Client does not wish to postpone their service or choose a new service, they may request a refund of their prepayment. It is specified that if this cancellation is necessitated by circumstances of force majeure (as defined in Article 1218 of the Civil Code), the Client will not be entitled to any compensation.

  • In such an event, the refund will be processed, at Beroa*'s discretion, either by credit to the Client's bank account or by bank transfer, within 14 days at the latest following Client validation. 


Article 16: Hygiene Measures - Internal Regulations

· For hygiene purposes, Clients are required to bring a swimsuit. Swim shorts are prohibited. The applicable hygiene and safety measures within Beroa* Institutes are further detailed in the "Frequently Asked Questions" section of each Beroa* Institute.

  • Each Beroa* Institute has internal regulations available for on-site consultation, which the Client agrees to review before the start of their service or their access to the Institute, and commits to respecting. Appropriate attire is required at all times. Any behavior or remarks contrary to public decency or public order will result in Beroa* requesting the Client to leave the Institute, without any refund if payment has been made, or compensation. Clients are not permitted to bring any outside beverages or food items into the Institute. The general prohibition of smoking in public places applies within Beroa* Institutes. Clients must adhere to the specific rules of each Beroa* Institute regarding the authorization or prohibition of smoking or using electronic cigarettes.

 

Article 17: Liability 

  • The services offered comply with current French legislation. Beroa* cannot be held liable for non-compliance with the legislation of a third country. 

  • Beroa* cannot be held responsible for the non-performance or improper performance of a reservation in cases of force majeure, or due to the actions of a third party or the Client.

  • The photographs, graphic representations, video content, and narratives displayed on the website www.beroa.fr are not contractual. The Client cannot claim any complaint or compensation on this basis.

  • Beroa* is responsible for the proper execution of services included in the contract, in accordance with Article L.211-16 of the Tourism Code, and is obligated to provide assistance to the Client if they encounter difficulties, pursuant to Article L.211-17-1 of the Tourism Code.

 

Article 18: Personal Data

  • The European General Data Protection Regulation (GDPR), which came into effect on May 25, 2018, expands and simplifies the exercise of Client rights by enhancing transparency in the processing of their personal data.

  • For any inquiries regarding Client data : The Client may send an email, attaching proof of identity, to the Data Protection Officer (DPO) using the following address: contact@beroa.fr.

En fonction de la nature de sa demande, le déroulement de la procédure sera différent :
- Conformément à l'article 15 alinéa 3 du RGPD, le Client dispose d'un droit de consultation de ses données personnelles. Après avoir effectué sa demande par courriel à destination du DPO, l'ensemble des données le concernant lui sera transmise en pièce jointe par email au format PDF dans un délai de 48h (jours ouvrables).
- Conformément à l'article 16 du RGPD, le Client dispose d'un droit de rectification. Pour que sa demande soit traitée, il doit indiquer les rectifications souhaitées dans son courriel de prise de contact. Une fois les changements effectués, un courriel de confirmation lui sera envoyé dans un délai de 48h (jours ouvrables).
- Conformément à l'article 17 du RGPD, le Client dispose du droit à l'oubli. Pour procéder à la suppression de ses données personnelles, le Client doit faire sa demande par courriel en précisant les informations qu’il souhaite retirer. Un courriel de demande de confirmation lui sera envoyé dans un délai de 48h (jours ouvrables) avant de procéder à toute opération de destruction des données personnelles le concernant.
- Conformément à l'article 18 du RGPD, le Client dispose du droit de demander la limitation du traitement. Pour que sa demande soit traitée, il doit indiquer les limitations souhaitées dans son courriel de prise de contact. Une fois les changements effectués, un courriel de confirmation lui sera envoyé dans un délai de 48h (jours ouvrables).
- Conformément à l'article 20 du RGPD, le Client dispose du droit de demander la portabilité de ses données. Après avoir effectué sa demande par courriel à destination du DPO, l'ensemble des informations le concernant lui sera transmise ou sera transmise à la personne que vous nous indiquerez, en pièce jointe par email au format PDF dans un délai de 48h (jours ouvrables).  

Donnnées personnelles recueillies par Beroa* :
- Pour toute réservation réalisée par téléphone ou par courriel, Beroa recueille : le nom du Client, son prénom, son adresse postale, son adresse e-mail, son numéro de téléphone fixe, son numéro de téléphone portable, sa date de naissance, ses informations bancaires, le nom et le prénom du ou des autres participants ;
- Pour toute réservation par Internet depuis le site Internet https://www.beroa.fr, Beroa* recueille : le nom du Client, son prénom, son adresse postale, son adresse courriel, son numéro de téléphone fixe, son numéro de téléphone portable, sa date de naissance, le nom et le prénom du ou des autres participants.
- Par le biais du « formulaire de contact » accessible depuis le site Internet, https://www.beroa.fr et pour toute demande de brochure, Beroa* recueille : le nom du Client, son prénom, son adresse postale, son adresse e-mail, son numéro de téléphone fixe, son numéro de téléphone portable
- Beroa* est susceptible de recueillir ces mêmes données personnelles lorsqu’elles sont communiquées lors de conversations avec les conseillers Beroa*, par le biais du module Chat accessible depuis son site Internet https://www.beroa.fr, outre la ville de provenance de l’utilisateur du service et son adresse IP

 Ces données sont nécessaires aux traitements suivants :
- Gestion commerciale :
-> Réservation / confirmation: les informations qui sont demandées au Client sont nécessaires au traitement de sa réservation et seront enregistrées dans la base de données commune aux Instituts Beroa*. A défaut de renseignement, Beroa* ne pourra traiter la réservation.
-> Satisfaction et suivi des Clients
-> Amélioration de notre suivi et service client
-> Envoi d’informations et offres promotionnelles personnalisées - Gestion comptable - Traitement de statistiques - Pour répondre à des obligations légales ou règlementaires 

• Les données personnelles que le Client communique à Beroa* à l'occasion de sa commande ne sont ni vendues, ni transmises à aucun tiers. Ces informations sont considérées par Beroa* comme étant confidentielles. Elles sont utilisées uniquement par les services internes de Beroa* notamment, pour le traitement de la commande du Client et pour renforcer et personnaliser la communication et l'offre de services réservés aux Clients de Beroa*.

• Ces données personnelles sont conservées pendant 5 ans à compter de la date d’enregistrement.

• Le Client dispose de la faculté de consentir expressément à recevoir de la prospection directe sous forme de courrier électronique de courrier postal ou par SMS. Le Client dispose de la faculté de s’opposer, par courrier électronique ou par courrier postal en recommandé avec accusé de réception, à ce que les données le concernant soient utilisées à des fins de prospection, notamment commerciale. 

 • The Client may register for free on the telephone solicitation opt-out list via the website: www.bloctel.gouv.fr

Article 19: Intellectual Property

· All texts, images, and sounds reproduced on Beroa*'s website www.beroa.fr are reserved under worldwide intellectual property rights.

  • These General Terms and Conditions of Sale do not entail any transfer of intellectual property rights of any kind concerning elements belonging to Beroa* or its rights holders, such as photographs, images, literary texts, artistic works, trademarks, graphic charters, or logos, for the benefit of the Client. 

  • Any internet user who maintains a personal website and wishes to place a simple link on their site, for personal purposes, directly referring to the homepage of www.Beroa.fr, must obtain prior and express authorization from Beroa* to establish this link.

  • In any event, hypertext links referring to the website www.beroa.fr must be removed upon Beroa*'s first request. 

 

Article 20: Beroa*'s Complaint Handling Procedures 

Consumers may submit their complaints to the following address: BEROA: 134, bd de la plage – 33120 ARCACHON, by email at: contact@beroa.fr, or by telephone at 09 51 62 10 13 (standard call cost, not surcharged).

      • The Client must allow Beroa* a reasonable period to investigate the complaint and, if necessary, to remedy it.

      • Should a resolution not be found within 30 days following the Client's complaint to Customer Service, the Client may contact the Tourism and Travel Mediator, whose contact details are provided in Article 23 of these General Terms and Conditions of Sale. 


Article 22: Applicable Law and Dispute Resolution

      • The applicable law is French law.

      • In the event of a dispute, and failing an amicable agreement between the parties, the territorially competent court shall be seized.
